Individuals who accessed a Banner Health patient account between June 1, 2020, and November 22, 2023, may qualify for a $20 payment under a proposed class action settlement. The group includes approximately 1,028,000 people who used the service, formerly known as the MyBanner patient portal.
The legal action stemmed from allegations that Banner Health improperly shared patient data with third-party companies, including Meta and Google, via tracking technologies embedded in its website and mobile applications. The plaintiffs asserted that these practices violated privacy laws. Banner Health denied any wrongdoing but agreed to the settlement to avoid the costs and uncertainties of prolonged litigation.
To receive the cash payment, class members must submit a valid claim by the September 5, 2026, deadline. Eligible individuals can complete an online form or mail a printed PDF to the settlement administrator. Payments will be distributed via Venmo, PayPal, or Zelle for online submissions, or by paper check for mailed claims. The administrator’s mailing address is P.O. Box 225391, New York, NY 10150-5391.
In addition to the monetary award, all class members will automatically receive a one-year subscription to CyEx Privacy Shield Pro. This service includes dark web monitoring, a virtual private network, password scanning, and data broker opt-out features. The cost for these privacy services will be determined based on the total number of valid claims received.
The settlement fund also covers attorney fees and costs, which may reach $3.75 million, and service awards of $2,500 each for eight class representatives. Administration costs are yet to be determined. A final approval hearing is scheduled for September 10, 2026. Payments to eligible members will be distributed approximately 60 days after the court grants final approval and resolves any appeals. Individuals who received a notice regarding this settlement are considered class members.
